Terms & Conditions Curacao Luxury Holiday Rentals. v. 11-01-2026

1. Acceptance of Terms & Conditions
1.1 These Terms & Conditions apply if you make a booking to rent property of Curacao Luxury Holiday Rentals for a period of less than 92 days. For bookings for periods of 92 days or more, other general conditions apply.
1.2 When you complete a booking with Curacao Luxury Holiday Rentals and/or stay in one of the apartments/villas of Curacao Luxury Holiday Rentals, you agree with these Terms & Conditions.
1.3 All persons falling within the definition of “Guest” shall be jointly and severally bound by these Terms and Conditions and the Primary Guest shall be responsible for ensuring compliance by all Guests belonging to their party.

1a. Definitions
1a.1 Check-in date: scheduled check-in date as agreed in the booking to rent the Rented Property from Curacao Holiday Rentals.
1a.2 Check-out date: scheduled check-out date as agreed in the booking to rent the Rented Property from Curacao Holiday Rentals.
1a.3 Curacao Luxury Holiday Rentals: AC Real Estate BV acting under the trade name Curacao Luxury Holiday Rentals as the party providing the rental services under these Terms & Conditions.
1a.4 Guest or You: (a) the person who has made the booking for the Rented Property, (b) the person(s) for whom the booking is made and who will occupy the Rented Property during the rental period and (c) any and all companions, family members, invitees, or other persons accompanying or invited by the Primary Guest, staying at, visiting, or otherwise using the Rented Property during the rental period.
1a.5 Primary Guest: the guest as mentioned under a and b of article 1a.4. 1a.6 Rented Property: one of the apartments/villas of Curacao Luxury Holiday Rentals which are rented by or on behalf of the Primary Guest including its contents like furniture, utensils etc.
1a.7 Rented Property Common Areas: the common areas belonging to the Rented Property including but not limited to the hall, garden, stairs etc.
1a.8 Late Arrival: arrival after the Check-in Date no matter the reason for the Late Arrival.
1a.9 Early Departure: arrival after the Check-out Date no matter the reason for the Early Departure.
1a.10 Rental Fee: the price for renting the Rented Property.

2. Rental Fee and payment
2.1 Rental Fee used are in USD, unless specifically mentioned otherwise.
2.2. Standard rates are based on an occupancy of the maximum number of Guests per Rented Property and a minimum stay of 5 nights. Children 0 – 3 years stay free of charge, including cot and high chair.
2.3 Upon arrival at the Rented Property a security deposit is to be paid where the amount depends on the duration of stay. This security deposit must be paid during check-in. The security deposit is as follows:
▪ Stay of less than 30 nights: USD 500,– deposit
▪ Stay between 30 and 90 nights: USD 800, – deposit.
This amount will be reimbursed at check-out unless article 7 and/or article 11 applies.
2.4 The total amount of the Rental Fee is payable within 48 hours after the booking has been confirmed and can be paid by bank transfer to the bank account of Curacao Luxury Holiday Rentals. In case of non timely payment Curacao Luxury Holiday Rental will take the necessary (legal) steps to enforce payment.
2.5 In case of bookings of more than 1 month, it is possible to pay the Rental Fee per month whereby the first month has to be paid in accordance with article 2.4 of these Terms & Conditions. The second month and further then have to be paid prior to the first of that month.
2.6 Curacao Luxury Holiday Rentals can also email you a payment link for credit card payment for VISA or MasterCard or American Express if you inform us via email if you wish to pay be credit card. Curacao Luxury Holiday Rentals only accepts credit cards with 3D security.

3. Services
3.1 Weekly cleaning after one week stay is included in the Rental Fee. In this case the cleaning is performed once a week and includes a change of bed linen free of charge.
3.2 It is possible to opt for additional cleaning against extra costs.

4. Facilities
4.1 Each Rented Property is fully furnished and equipped. This includes a fully equipped kitchen, with cutlery and kitchen utensils present in the Rented Property.
4.2 Working Wi-Fi is complementary. Curacao Luxury Holiday Rentals however can’t be held responsible for loss and/or disturbance of the internet connection. When the internet connection is lost, Curacao Luxury Holiday
Rentals will guarantee to do everything within its power to fix the connection as soon as possible.
4.3 The Rental Fee also includes air conditioning, electricity, water and television. All appliances in the Rented Property, e.g. lights, air conditioning etc. need to be switched off when not in use. Excessive use of water or electricity will result in extra costs.

5. Cancellation
5.1 Notification of cancellation of your booking needs to be presented to Curacao Luxury Holiday Rentals in writing. When notification of cancellation is received up to 45 days prior to the Check-in Date concerned, no costs will be involved.
5.2 In the case of cancellation from 45 days to 30 days prior to the Check-in Date, 50% of the paid Rental Fee will be refunded.
5.3 In the case of cancellation from 30 days to 14 days prior to the Check-in Date, 20% of the paid Rental Fee will be refunded.
5.4 In case of cancellation from 14 days prior to the Check-in Date as well as in case of a no show, the paid Rental Fee will not be refunded.
5.5 In the event of a refund as mentioned in the articles 5.2 and 5.3, Curacao Luxury Holiday Rentals will pay the refund to the Guest in the same currency as the paid Rental Fee. Costs that may be charged by your bank on the refund of the paid Rental Fee will not be reimbursed by Curacao Luxury Holiday Rentals.
5.6 Articles 5.1 – 5.5 do not apply if the booking is made against non-refundable rates which will be stated explicitly when making the booking.

6. Late Arrival and Early Departure
6.1 In case of Late Arrival, the total Rental Fee will be charged.
6.2 In case of Early Departure, the total Rental Fee will be charged and the reservation ends on the confirmed new departure date.

7. Damage to the Rented Property
7.1 During his stay, the Guest is responsible for the Rented Property. This also means the Rented Property (including the garden if the Rented Property is a villa) is left clean and in good condition upon check out.
7.2 In the case of damage to the Rented Property and the Rented Property Common Areas due to actions of the Guest, his negligence or irresponsible behavior, damage has to be reported to Curacao Luxury Holiday Rentals immediately. Curacao Luxury Holiday Rentals remains the right to charge the full amount of the damage caused.
7.3 When the keys of the Rented Property including the remote for the car gate are lost by the guest, a 180,– XCG fee will be charged to the guest.
When only the keys of the Rented Property are lost a fee of 50,– XCG will be charged.
7.4 When the Rented Property (including the garden if the Rented Property is a villa) is left in extraordinary filthy state an extra fee will be charged to the Guest by Curacao Luxury Holiday Rentals. This fee will be equal to the actual costs made in order to clean the Rented Property (including the garden if the Rented Property is a villa) and will be retained from the security deposit.
7.5 In case of damages in the Rented Property and/or the Rented Property Common Areas, the Guest is required to inform Curacao Luxury Holiday Rentals immediately in writing (by app or email) or by telephone. Curacao Luxury Holiday Rentals will always seek to solve the damages as quickly as possible.
7.6 It is strictly forbidden for the Guest to carry out repairs and/or to make changes/adjustments on or in the Rented Property (including but not limited to drill holes in walls, painting the walls). In case of violation of this article, the Guest will be liable for total repair costs.
7.8 It is strictly forbidden for the Guest to change the furniture and/or utensils and/or to remove the furniture and/or utensils from the Rented Property. In case of violation of this article, the Guest will be liable for the damage.
7.9 In case of damage and/or charge of costs as mentioned in the articles
7.1 – 7.8, the security deposit will be used for this but if the damage and/or the charge of costs exceeds the security deposit Curacao Luxury Holiday Rentals will charge the excess.
7.10 Curacao Luxury Holiday Rentals declines all responsibility for loss of and/or damage to the Guest’s properties in case of (but not limited to) fire and/or theft.

8. (Number of) occupants
8.1 Only the (number of) persons mentioned in the booking, are allowed to stay overnight in the Rented Property. In case of violation of this article, Curacao Luxury Holiday Rentals will remain the right to end the stay immediately.

9. Modification and extension of bookings
9.1 Modification of bookings can only be requested up to 45 days prior to the Check-in Date. In such situation Curacao Luxury Holiday Rentals will endeavor to modify the booking. Curacao Luxury Holiday can however not guarantee such modification.
9.2 in case of a modification as mentioned in article 9.1, the nightly rate used in respect of the modification can differ from the nightly rate used in
your original booking. Curacao Luxury Holiday Rentals will always notify you when this is the case and ask for your approval before finalizing the requested modification.
9.3 In case the Guest requests an extension of the booking, Curacao Luxury Holiday Rentals will endeavor to extend the booking. Curacao Luxury Holiday can however not guarantee such extension.
9.4 in case of an extension as mentioned in article 9.3, the nightly rate used in respect of the extension can differ from the nightly rate used in your original booking. Curacao Luxury Holiday Rentals will always notify you when this is the case and ask for your approval before finalizing the requested extension.

10. Check-in & check-out policy
10.1 Check-in time is as from 16.00 hours on the Check-in Date and check out is prior to 11.00 hours on the Check-out Date. Late check-out may be possible subject to the reservation status of the Rented Property and against extra costs.
10.2 The Guest vacating the Rented Property beyond the time agreed upon will be charged a full day’s Rental Fee, equal to the applicable nightly rate on the day the Rented Property is agreed upon to be vacated.

11. Fair Use
11.1 The Guest will act in accordance with the Domestic Rules of the Curacao Ocean Resort (the SCOR Domestic Rules), which rules are available on paper in the Rented Property.
11.2 The Guest will use the Rented Property and the Rented Property Common Areas in a correct manner.
11.3 The Guest will not use the Rented Property for running any commercial business including but not limited to (illegal) prostitution. In case of violation of this article, Curacao Luxury Holiday Rentals will remain the right to end the stay immediately and charge a 20.000,- USD fine.
11.4 In the Rented Property and/or the Rented Property Common Areas, the Guest will not cause any nuisance, disturbance, or annoyance, engage in any activity that interferes with the quiet enjoyment of neighboring persons, generate excessive noise, particularly during nighttime hours (defined as 10:00 PM to 7:00 AM) and/or allow the accumulation of waste, debris, or any materials that may cause odors, attract pests, or create unsanitary conditions. In case of violation of this article, Curacao Luxury Holiday Rentals will remain the right to end the stay immediately and charge a
500,- USD fine.
11.5 Smoking is strictly forbidden in the Rented Property. In case of violation of this article, Curacao Luxury Holiday Rentals will remain the right to end the stay immediately and charge a 300,- USD fine. In case the smoking alarm is activated as a result of the smoking an additional fine of 600 USD will be charged, in which case the total fine will be 900,- USD.
11.6 It is not allowed for the Guests to bring pets to the Curacao Ocean Resort and/or to the Rented Property and/or the Rented Property Common Areas. In case of violation of this article, Curacao Luxury Holiday Rentals will remain the right to end the stay immediately and charge a 500,- USD fine.
11.7 It is strictly forbidden for the Guest to sublease the Rented Property to third parties. In case of violation of this article, Curacao Luxury Holiday Rentals will remain the right to end the stay immediately and charge a 2.500,- USD fine.
11.8 In case of fines as mentioned in the articles 11.3 – 11.7, the security deposit will be used for this but if the fine exceeds the security deposit Curacao Luxury Holiday Rentals will charge the excess.

12. Insurance
12.1 Renting an apartment/villa at Curacao Luxury Holiday Rentals does not include any kind of insurance. Curacao Luxury Holiday Rentals therefore recommends its guests to provide themselves with travel – and health insurances.

13. Liability
13.1 Curacao Luxury Holiday Rentals does not accept liability for temporary failure or disruptions in and around the Rented Property of water and/or energy supplies.
13.2 Curacao Luxury Holiday Rentals cannot be held liable for accidents in or around the Rented Property
13.3 The use of the swimming pool and the beach area is entirely at the Guest’s own risk. The Guest will make sure there is always an adult at the pool when children are using the pool and/or using the beach area and/or swimming in the sea.
13.4 If you are staying in one of the villas of Curacao Luxury Holiday Rentals, the standing on and or jumping of seafront cliffs is not allowed, Curacao Luxury Holiday Rentals does not accept liability for any damage or injuries caused by standing on and or jumping of seafront cliffs.
13.5 Curacao Luxury Holiday Rentals is not liable for nuisance caused by construction, by third parties or for work on public roads.
13.6 All the Rented Property is located on the Bapor Kibra z/n Curacao Ocean Resort, Willemstad Curacao and are thus subject to national and local
laws and regulations of Curacao. Such laws may change without notice. In the event that new or existing laws, governing the short-term rental of properties come into effect, this may have an adverse effect on such rentals (including, but not limited to, prohibition of such rentals). In this case, Curacao Luxury Holiday Rentals will refund the paid Rental Fee and the security deposit. Responsibility for the enforcement, amendment or introduction of such laws, is not accepted by Curacao Luxury Holiday Rentals and no compensation of other damage will take place.

14. Force Majeure
14.1 For the purposes of this article, “Force Majeure” means any event or circumstance beyond the reasonable control of Curacao Luxury Holiday Rentals, including but not limited to: acts of God, natural disasters (including earthquakes, floods, storms, hurricanes, or fires), epidemics, pandemics, government orders or restrictions, acts of war, terrorism, civil unrest, strikes, power failures, or any other unforeseeable circumstances that prevent the Guest from occupying the Rented Property or Curacao Luxury Holiday Rentals from providing the Rented Property as agreed.
14.2 Curacao Luxury Holiday Rentals shall not be held liable for any failure or delay in performing its obligations if such failure or delay is caused by Force Majeure events. This includes, but is not limited to, the inability to provide access to the Rented Property or any amenities or services associated with the rental.
14.3 In the event that a Force Majeure occurrence prevents the Guest from occupying the Rented Property or completing his stay, no refund of paid Rental Fee or other fees paid shall be provided except for the security deposit as mentioned under article 2.3 in case of disruption of the stay. The Guest is strongly advised to obtain comprehensive travel insurance that covers cancellations due to Force Majeure events.
14.4 Neither party shall be liable to the other for any failure to perform obligations under this Agreement due to a Force Majeure Event.

15. Modification of Curacao Luxury Holiday Rentals & Conditions
15.1 The terms & conditions of Curacao Luxury Holiday Rentals can be changed at any time without notice. The terms & conditions on this page are leading and most up to date.
